*Swear in Nelson Chamisa as President or re-run the Presidential election*

The Zimbabwean judiciary must swear in Nelson Chamisa as President of Zimbabwe with immediate effect or call for peaceful, free, fair, credible and international conducted re-run of the Presidential election.

The alteration of figures by ZEC reveal that the Presidential figures were tempered with in favour of the outgoing President Emmerson Mnangagwa.

We are not going to accept Mnangagwa as Zimbabwe’s President because it is clear that he didn’t win the elections.

It is therefore prudent to declare and swear in Nelson Chamisa as Zimbabwe’s legitimate leader. The second option is to set aside the fraudulent result and re-run the Presidential election altogether.

We urge the people of Zimbabwe to remain on high alert as we move to defend the people’s choice.

Do not be intimidated. They will not dare shoot anyone again. They are hoping to rely on the fear they instilled when they shot ten people dead on the 1st of August 2018.

We are winning already. They’re exposing themselves and their lies and pilfrage are falling apart. We all need to play our part as citizens and as a movement.

We are the custodian of our own votes. We are our own voices. We together and collectively have the power to take our Mnangagwa and his gang of criminals.

They’re in the minority. They don’t control the army. They’re actually more scared of us than we know it, hence the shootings. They’re weak and defeated. They’re actually praying that we don’t do anything. The moment we start to act together as citizens in pursuit of our vote they will only have but only one option-to run, and run they will!

We are going to keep you updated on a daily basis. We are winning we are winning we are winning. Let us not give up or yield of to their empty threats. The real Zimbabwe National Army is not on their side NOT to mention the police, CIO and other security organs. They’re all on the side of the people. They waiting counting and hoping on you and me to take the first step. Let us remain vigilant and mobilised. We shall be informing you of the next course of action.

Mnangagwa lost the Presidential election. He must concede and step down. If not there must be re-run of the Presidential elections that is peaceful, free, fair, credible and internationally supervised.

Immediate Release of Mogen Komichi

We have already stated that we don’t recognize Emmerson Mnangagwa’s pyrrhic victory. We have also put his regime on notice that his illegal, illegitimate and criminal reign will be fought and resisted with everything we have got.

We have learnt with utter amazement the arrest and dention of Morgen Komichi for announcing that he had refused to sign fraudulent electoral result papers.

We demand the release of Komichi immediately and a stop to all forms of intimidation and harassment of citizens.

Countrywide organisation and mobilisation processes are underway to openly disregard and defy Mnangagwa’s unlawful ascendancy to the the country’s Presidency.

#Presidential Election Petition Update – Points Arising From Advocate Lewis Uriri’s Interview today.

We await a hard copy of ED’s Opposing Affidavit to get a complete picture. However, a few points arise from the interview which need further exploration:

a. He argues that Chamisa and his team served the papers a day late, meaning that they will actually be seeking to defeat the Petition on a technicality, as previously suggested and addressed. Such an approach would be explosive and likely cause an implosion, although it would present the easiest way of disposing of the application without placing the bench in a difficult position.

b. He also argues that the Petition is high on political rhetoric and low on evidence, particularly V11 Forms & on the law.

c. He further contends that Chamisa & his team ought to have sought an order compelling a recount to be undertaken. All of this, on paper, appears cogent & equally compelling.

d. I just want to flag up something that I have come across that I feel is highly relevant. This pertains to V11 specific evidence referred to in Chamisa’s Petition. This is referred to on page 125 – 129, in the form of “Sample V11 Forms” titled “Annexure A”, Item number 21, then Item number 28, “Annexure F3” – which is a CD with V11 Forms, appearing on page 151, then Item number 38, in the form of “Signed and unpopulated V11 Forms”, which is “Annexure P”, appearing on pages 176 – 199, then Item number 39, which is “Annexure Q”, titled “Doctored V11 Forms” and appears on pages 200 – 202.

e. It remains to be seen whether or not that adequately tallies with all returns throughout Zimbabwe but certainly, 1) that is evidence which is backing the “rhetoric”, 2) the CD could hold all returns in digital format and, 3) the Petition necessarily puts ED & ZEC in a position where they have to provide their own V11 & V23 Forms which are consistent with what other candidates have as returns and which are capable of contradicting the returns Chamisa and his team have or are claiming to have, so things will get very interesting.

f. It appears to me that both sides are currently embroiled in the equivalence of sabre rattling, motivated by a desire to land a significant psychological blow and demoralise the other side before the action commences.

g. We can now get a sense of ED’s strategy vis-a-vis defeating the petition. It will be – i) deploy the technical argument about lateness in the service of the petition first, then argue that the V11 & V23 returns that are there fatally undermine Chamisa’s case, whilst also suggesting that Chamisa’s team ought to have asked for a recount. The rest of the other claims will be defended as suggested in yesterday’s instalment.
